O R D E R
The petitioner apprehends arrest at the hands of the respondent police for the offence under Section 4(1)(A) of Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.938 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner joining 1/4
hands with other accused while transporting huge quantity of 500 bottles of 180 ml liquor bottles from Karaikal to Tamil Nadu in two two-wheelers, the police party intervened and, on seeing the police, this petitioner stopped the vehicle and ran away from there whereas, the other persons were arrested and the property was recovered. It was also revealed that the petitioner is also involved in this case. Hence, a case has been registered.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case based on the confession statement of the co-accused. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent/State reiterated the prosecution case and, upon instructions, submitted that this petitioner driven the two wheeler and after seeing the police party stopped the vehicle and ran way from there. He further submitted that two wheeler and 300 liquor bottles was recovered from this petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case; and taking note of the submission made by the learned Government Advocate (Crl.Side); and 2/4
considering the fact that huge quantity of liquor bottles has been transported from Union Territory of Puducherry to Tamil Nadu and though it is stated that the properties were recovered, this Court is of the view that if the petitioner is enlarged on anticipatory bail, he would indulge in similar offences. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
