O R D E R

The petitioner apprehends arrest for the alleged offence under Section 4(1) (A) and 4(1)(C) of TNP (Amendment) Act and 24 of TNP Act, in Crime No.429 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that while the respondent police was on 1/4

regular patrol, the petitioner along with other accused were found in illegal possession of King Fisher Beer - 06 (650 ml), Mc Dowells -12 (180ml), Bascardi Lemon -4, Mc Dowells VSOP-9, Orange Vodca-5, Old Secret & Vannila Vodka-5, honey Day-1, King Louis-3, 1848 Whisky-1, totally 54 bottles of liquor near TASMAC, for the purpose of selling to the public and cash of Rs.1,100/- and the same was seized by the respondent police. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case based on the confession of the arrested accused. He further submitted that the petitioner is only supplier of the TASMAC Bar and he had no knowledge about the selling of liquor bottles. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to cooperate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and upon instructions submitted that totally there are three accused in this case and that the petitioner is ranked as A3. He further submitted that the petitioner was having 17 previous cases of similar in nature and that the investigation in this case is 2/4

also pending. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); the nature of allegation; the investigation of this case is still pending, and also the fact that 17 previous cases of similar in nature has been registered against him, this Court is not inclined to grant anticipatory bail to the petitioner.
