PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 to 4 take action against the 5th and 6th respondents on the ground of malpractice and violation of Crl.OP.No.5758 of 2025 passed by the Honourable High Court of Madras based on the petitioners representation dated 06.09.2025 made to the respondents 1 to 6 herein.

ORDER
Writ Petition has been filed for a direction, directing the respondents 1 to 4 to take appropriate action as against the 5th and 6th respondents herein. 2.The learned Government Advocate (Crl. Side), on instructions, submitted that on receipt of the said complaint from the petitioner, it was registered in Crime No.606 of 2024, on the file the Inspector of Police, Kallakurichi Police Station, for the offence under Section 194 of BNSS, 2023. However, the said complaint was closed as mistake of fact and the petitioner was also issued Referred Charge Sheet Notice. 3.However, the learned counsel for the petitioner submitted that so far no Referred Charge Sheet notice was received from the Investigation Officer.
4.In view of the above, the Inspector of Police, Kallakurichi Police Station is hereby directed to serve the Referred Charge Sheet Notice to the petitioner within a period of one (1) week from the date of receipt of a copy of this order. On receipt of the same, the petitioner is at liberty to lodge a private complaint, if so advised.
5.With the above direction, this Writ Petition stands disposed of. No costs.
