ORDER
This Writ Petition has been filed seeking a direction to the respondent to pay the petitioner the amount payable towards encashment of 90 days of Earned Leave surrendered by him prior to his retirement, together with interest at the rate of 18% per annum from the respective due dates or based on the monthly wages payable during the month of his retirement.
2. Mr.Gawthamaraj, learned counsel takes notice on behalf of the respondent.
3. The case of the petitioner is that he was worked as a Foreman in the Head Office Electrical Branch of the first respondent Transport Corporation and retired from his service on 30.06.2015. It is the further case of the petitioner that the encashment of the surrendered Earned Leave salary for 90 days was not paid at the time of his retirement. Consequently, he made a representation dated 18.02.2025 to the respondent, seeking payment of the surrendered Earned Leave salary along with interest at 18% per annum. However, the same has not been considered till date and therefore, the present Writ Petition has been filed.
4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the respondent to consider the representation of the petitioner and pass appropriate orders on the same within the time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned counsel appearing for the respondent.
6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondent to consider the petitioner's representation dated 18.02.2025 and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
