ORDER

The petitioner who belongs to Hindu Adi Dravidar community came in friendly contact with the 7th respondent - Karthikeyan. Both of them met through an inter college athletic events. In the year 2022, the petitioner got employed in ICICI Bank, Ambattur and the 7th respondent joined the Commando Force in Chennai. Both of them were aware about their respective castes and the social background. The 7th respective made a promise that he will marry the petitioner and since the promise was made in front of the Vadapalani Murugan Temple, the petitioner had no reason to doubt. Thereafter, on that promise, the 7th respondent had physical relationship with the petitioner on several occasions during the period from 2022 to 2025.

2. When the petitioner's father discussed their marriage with the 7th respondent, the 7th respondent insulted him by making derogatory casteist remarks. Later, during April 2024, the 7th respondent apologised to the petitioner and promised that he will convince his parents and marry her. Further, the 7th respondent informed the petitioner that due to online gaming he had suffered financial loss and pleaded for help from the petitioner. The petitioner had taken personal loan to the tune of Rs.9 Lakhs and handed over to the 7th respondent. Neither the amount was repaid nor the marriage as promised was conducted and later, the 7th respondent citing the petitioner's caste abused her

and started avoiding her and also spreading tantrums against the petitioner. Hence, the petitioner lodged a complaint and CSR was assigned and no further action has been taken. Hence the present Writ Petition.

The learned Additional Public Prosecutor appearing for respondents 1 to 6 submitted that, based on the petitioner's complaint dated 31.10.2025, a case in Crime No. 3 of 2026 was registered against the 7th respondent for offences under Section 69 of the BNS, 2023, and Sections 3(1)(r), 3(1)(s), and 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. His uncle, father, mother, and others were called for enquiry. Subsequently, the Deputy Commissioner of Police, Chennai, in his communication dated 24.03.2026, nominated the Investigating Officer, P. Dekshinamoorthy, Assistant Commissioner of Police, Vepery Range, to complete the investigation. The investigation has now commenced, and a final report will soon be filed before the concerned Court.
