ORDER
Mr.P.Balathandayutham, learned Special Government Pleader takes notice on behalf of the respondents 1 & 2.
2.By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3.This writ petition has been filed, directing the 1st respondent to approve the appointment of the petitioner as BT Assistant in History pursuant to the proposal submitted by the 3rd respondent on 09.07.2025. 4.The case of the petitioner is that she applied for the post of B.T Assistant (History) pursuant to the notification issued by the 3rd respondent school, an aided minority institution managed by the India Evangelical Lutheran Church (IELC), vide proceedings dated 06.01.2020. Though the petitioner was fully qualified for the post, she was was appointed only as a Secondary Grade Teacher against the existing vacancy of one Mr.G.Jabus Ezhil Enbakkan, who previously held the position of B.T Assistant (History). The appointment order dated 12.06.2023 was forwarded to the 1st respondent for approval, but no orders have been passed till date. The petitioner possesses the required
qualifications, including D.T.Ed., B.Sc., B.Ed., (History) and Special Education (Hearing Impairment) from the Tamil Nadu Teachers Education University. Despite handling History classes for Grades VI to X since June 2023, the petitioner remains designated as a Secondary Grade Teacher and is working without salary. Meanwhile, one Mr.Sivaraj, who lacked the requisite qualifications, sought approval for appointment as B.T Assistant (History) and filed W.P No.11312 of 2024. Upon scrutiny, the 1st respondent rejected his proposal vide proceedings dated 17.12.2024 on the ground of invalid educational qualifications. The petitioner subsequently filed W.P No.6900 of 2025 seeking a direction to the 3rd respondent to revise the appointment and submit the proposal for approval.
Pursuant to this, the 3rd respondent submitted a fresh proposal dated 09.07.2025 recommending the petitioner for appointment as B.T Assistant (History) considering the increased student strength and petitioner's eligibility. However, despite the submission of the revised proposal, the 1st respondent has not passed any orders, resulting in the petitioner continuing to serve without salary or designation as B.T Assistant (History). Hence, the present writ petition has been filed.
5. The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the proposal submitted by the 3rd respondent dated 09.07.2025, within a reasonable time.
6.The learned Special Government Pleader appearing for the respondents 1 & 2 would submit that the 1st respondent will consider the proposal submitted by the 3rd respondent dated 09.07.2025, and pass appropriate orders within a reasonable time to be fixed by this Court.
7.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the proposal submitted by the 3rd respondent dated 09.07.2025, on merits and in accordance with law and pass appropriate orders, within a period of eight (8) weeks from the date of receipt of a copy of this order.
