This criminal original petition has been filed to modify the condition imposed on the petitioner herein by the Special Court for the Exclusive Trial of EC and NDPS Act Cases, Salem in Crl.M.P.No.799 of 2025 dated 07.11.2025 that, the petitioner is directed to execute Rs.25,000/- bond with two sureties for the like sum and one surety shall be blood relative and another shall be local surety and the sureties should produce solvency certificate before the District Munsif Cum Judicial Magistrate, Arcot.

The learned counsel appearing for the petitioner submitted that, the petitioner herein was granted bail by the Special Court for the Exclusive Trial of EC and NDPS Act Cases, Salem, vide order dated 07.11.2025 in Crl.M.P.No.799 of 2025 for the offence under Sections 8(c) r/w 20(b)(ii)(c) and 29(1) of NDPS Act, 1985 in Crime No.74 of 2025 on the file of the respondent police with one of the conditions that, the petitioner shall execute a bond for Rs.25,000/- with two sureties each for the like sum and one surety shall be blood relative and another shall be local surety; that the petitioner herein is hailing from Andhra Pradesh, he is a coolie worker and running his life in deprivation, hence he is unable to mobilize the bond amount and to arrange the local surety; that inspite of granted bail on 07.11.2025, the petitioner is still languishing in jail due to the aforesaid condition, hence prays to modify the aforesaid condition. 2/4

Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

Considering the submissions made on both sides, the nature of offence, the period of incarceration undergone by the petitioner and taking note of the fact that, though the petitioner has been granted bail on 07.11.2025, he is still languishing in jail, this Court is inclined to modify the bond conditions to the effect that, "the petitioner is directed to execute bond for a sum of Rs.20,000/- (Rupees Twenty Thousands only) with two sureties each for the like sum and the sureties shall be blood relatives to the petitioner herein to the satisfaction of the District Munsif Cum Judicial Magistrate, Arcot. It is needless to say that the sureties need not directed to produced solvency certificate" and as far as the other conditions imposed on the petitioner herein, as per the aforesaid order remain unaltered.
