ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.12.2021 for the offences punishable under Sections 302, 201, 454, 380, 403, 406, 404 and 364 of IPC and Section 4(2) r/w 18 of POCSO Act, 2012 and charges framed against the accused under Sections 380, 403, 406, 364, 4(2) r/w 18 and 302 of IPC, Sections 201 and 404 of IPC in Spl.S.C.No.55 of 2022 pending on the file of the learned Principal Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore, seeks bail. 2.

The allegation against the petitioner is that, the petitioner had kidnapped the victim girl, committed penetrative sexual assault and also murdered her. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 17.12.2021; that the trial is not progressing; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the trial is progressing and all the prosecution witnesses were examined and Section 313 of Cr.P.C is also concluded; and that the case is posted for arguments. 5.

Considering the submissions made, facts and circumstances of the case, the nature of offence, the fact that the prosecution side witnesses were examined and the case is pending for arguments, this Court is not inclined to grant bail to the petitioner at this stage. 6.

Accordingly, this criminal original petition stands dismissed. 09.12.2025 stn To
