Respondents PRAYER Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue Writ of Mandamus, directing the 1st respondent to initiate appropriate action against the 2nd respondent for falsely implicating the petitioners as Accused in the case in Cr.No.81 of 2025, confining them under illegal custody of 2 days, committing brutalities and human right violation against them and committing sexual violence against the 2nd petitioner based on their representation dated 29.10.2025.

ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the 1st respondent to initiate appropriate action against the 2nd respondent for falsely

implicating the petitioners as accused in the case in Crime No.81 of 2025, confining them under illegal custody for 2 days, committing brutalities and human right violation against them and committing sexual violence against the 2nd petitioner, based on their representation dated 29.10.2025. 2.

The learned counsel appearing for the petitioners submitted that the petitioners were not at all involved in the offence, however, they have been illtreated and tortured by the second respondent at the time of arrest. Therefore, the petitioners had sent a representation dated 29.10.2025 to the first respondent to take action against the second respondent for falsely implicating them in the case. Since no action has been taken by the first respondent, the present Writ Petition (Criminal) has been filed.

Today, when the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondents submitted that the petitioners are the accused 3 and 4 in Crime No.81 of 2025 for the offences under Sections 311, 332(A), 61(2), 331(8), 49, 3(5), 309(4), 313 and 317 of the Bharatiya Nyaya Sanhita, 2023. The petitioners were arrested and remanded to judicial custody and they have come out on bail. Subsequently, the investigation has been completed and final report has also been filed and it is pending committal in PRC No.67 of 2025 on the file of the learned Judicial Magistrate No.II, Attur. He further submitted that the representation of the

petitioners has been considered and it has been disposed of. 4.

In such circumstances, the prayer for a writ of mandamus cannot be considered. Taking into consideration the fact that the representation of the petitioners dated 29.10.2025 has been considered and disposed of, the Writ Petition (Criminal) stands closed.
