O R D E R

The petitioner has made a claim against the 2nd respondent. It is due to the fact the dues alleged to be paid by the 2nd respondent were not disbursed. The petitioner approached the 1st respondent invoking Section 18 of the Micro, Small and Medium Enterprises Development Act of 2006. The said proceedings were taken on file in MSEFC/CR/126/2024 in March of 2024. On 12.03.2025, the matter was listed for 1st hearing. The 1st respondent issued notice to the 2nd respondent. Thereafter, no further steps were taken by the 1st respondent. The petitioner gave a representation on 19.11.2025 calling upon the 1st respondent to proceed further with his Claim Petition. As no action was initiated, he has come before this Court invoking Article 226 of the Constitution of India.

2. Taking into consideration the averments made in the affidavit, I called upon Mr.L.S.M.Hasan Fizal to get in touch with the 1st respondent and to get instructions on the time period within which the 1st respondent requires to proceed further with the Claim Petition.

3. Mr.L.S.M.Hasan Fizal sought for a day's time. I posted the matter today.

When I took up the matter, Mr.L.S.M.Hasan Fizal reports that he has been instructed by the 1st respondent that the proceedings in MSEFC/CR/126/2024 dated 03.03.2025 will be disposed of within a period of 90 days from the date of receipt of a copy of this order. The statement made by the learned Additional Government Pleader, made on behalf of the 1st respondent, is recorded.

5. There shall be a direction to the 1st respondent to dispose the MSEFC/CR/126/2024 within a period of 90 days as required under the MSME Act. Prior to passing any order, obviously, the 1st respondent will consider the plea of the 2nd respondent also.

6. The writ petition is disposed. No costs.
