O R D E R
The petitioner herein, who apprehends arrest at the hands of the first respondent police for the offences punishable under Sections 61(2), 316(5) and 318(4) of BNS in Crime No.365 of 2025 on the file of the respondents, seeks anticipatory bail.

The case of the prosecution is that, the petitioner herein joined hands with other accused namely Guru Raghavender, who is the bank employee and siphoned the Bank's money to the tune of Rs.2.50 Crores and invested some amount in the share market for making huge profits. Hence, this case. 3.
The learned counsel appearing for the petitioner submitted that the petitioner herein has been falsely implicated in this case; that the co-accused/ Guru Raghavender had only transferred money to the petitioner's account for the purpose of investing the same in share market and he was not aware about the misappropriation done by the co-accused; that the petitioner herein apart from investing the money given by the co-accused in the share market has not committed any offence; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and to co-operate for the investigation, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the co-accused/ A1 in this case has been arrested on 24.11.2025 and still in custody; that part of the siphoned funds were transferred to the account of the petitioner herein and so far no money is recovered; and that the investigation of this case is pending. 5.
Considering the submissions made, facts and circumstances of this case, nature of allegation and taking note of the fact that huge amount alleged to have misappropriated in this case and so far no money is recovered and the fact that investigation of this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
