Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.05.23 to 11.02.25 in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity and Encashment of Leaves within a time frame as may be fixed by this Court, and without affecting his right to claim balance amounts towards those benefits. ORDER

Mr.A. Vinoth, learned counsel takes notice for respondent. With the consent of both the parties, the writ petition is taken up for final disposal today at the stage of admission itself.

2. This writ petition has been filed to direct the respondent to pay interest for the belated payment of terminal benefits viz.,EPF Employees Contribution, Gratuity and Encashment of Leave etc., due to the petitioner, within a time frame to be fixed by this Court.

3. It is the case of the petitioner that he joined the services of the respondent Corporation in the year 1993 and retired from service on superannuation on 30.04.2023. It is the contention of the petitioner that though terminal benefits ought to have been paid to him by the respondent in the month of May 2023, but it has been paid, belatedly, i.e., only on 12.02.2025. Hence, he submitted a representation 13.10.2025 to the respondent seeking payment of interest for the delayed payment of the benefits. Hence, this writ petition.

4. Heard the learned counsels appearing on either side and perused the materials available on record.

In view of the limited request made by the petitioner with regard to interest on the belated payment of terminal benefits, this Court directs the respondent to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
