Vijayakumar Petitioner Vs The Management of Tamil Nadu State Transport Corporation (Kovai) Ltd., Erode Region, Rep. by its Managing Director, Erode Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.04.24 to 24.08.25 in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity and Encashment of Leaves/Aready Surrendered Earned Leave, within a time frame as may be fixed by this Court, and without affecting his right to claim balance amounts towards those benefits.

ORDER

Mr.A. Vinoth, learned counsel takes notice for respondent. With the consent of both the parties, the writ petition is taken up for final disposal today at the stage of admission itself.

This writ petition has been filed to direct the respondent to pay interest for the belated payment of terminal benefits viz., EPF Employee's Contribution, Gratuity and Encashment of Leave / Surrendered Earned Leave etc., due to the petitioner @ 18% p.a. for the period of delay from 01.04.2024 to 24.08.2025, within a time frame to be fixed by this Court.

3. It is the case of the petitioner that he joined the services of the respondent Corporation in the year 1986 and retired from service on superannuation on 31.03.2024. It is the contention of the petitioner that his terminal benefits were settled after a period of one year from the date of his retirement. In such circumstances, he submitted a representation dated 13.10.2025 to the respondent seeking payment of interest for the delayed payment of the benefits. Hence, this writ petition.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

In view of the limited request made by the petitioner with regard to interest on the belated payment of terminal benefits, this Court directs the respondent to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
