Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records with respect of the impugned order passed by the 3rd respondent in his proceedings in Na.Ka.No. 31859/2021/J3 dated 23.11.2023 and quash the same consequently direct the 3rd respondent to grant long term lease to the petitioner with respect of the Government Poramboke land comprised in SF No. 440/3 of E.Nallagoundampalayam Village, Paramathivelur taluk, Namakkal District in the light of Clause 24A of Revenue Standing Orders within a reasonable time as fixed by this Hon'ble Court and pass orders on the same within an appropriate time.

ORDER
The petitioner had submitted a representation in relation to the grant of long term lease to the petitioner for the poramboke land in S.F.No.440/3 of E.Nallagoundampalayam village. In relation thereto, W.P.No.34106 of 2022 was filed. Such writ petition was disposed of by order dated 04.01.2023 directing consideration of the request. The request was rejected. Challenging the rejection, W.P.No.34285 of 2023 was filed. The said writ petition was dismissed after noticing that a counter affidavit was filed by the tahsildhar
stating that the land is classified as natham poramboke and intended to be allotted for landless poor. The Court also noticed that a first appeal was pending at the instance of one Chennimalai Goundar and Nallappa Gounder. Against the dismissal of the writ petition, the petitioner filed W.A.No.1488 of 2025, which was dismissed by judgment dated 02.06.2025. The matter was carried to the Supreme Court in S.L.P.No.21445 of 2025. The said SLP was dismissed by order dated 21.11.2025. While dismissing the SLP, the Supreme Court granted permission to the petitioner to approach this Court for consideration under the relevant Board Standing Order. The present writ petition has been filed on the basis of such permission.
2. Learned counsel for the petitioner relies upon Revenue Standing Orders (RSO) 24A. He contends that the said RSO enables the grant of permission for temporary occupation, not exceeding three years, or a long term lease for a period of twenty years. RSO 24A pertains to the grant of permission for temporary occupation for a period not exceeding three years at a time to entities engaged in non-agricultural activities. It is needless to say that the RSO is only an enabling provision and that the Government may accede to the request, if the land is not required for any other purpose.
3. As regards land in SF.No.443/3, in the earlier proceedings, this Court took note of the counter of the tahsildhar stating that the land is required for
allotment to landless poor, and rejected the writ petition. A request for either temporary occupation or long term lease cannot be re-agitated by way of this writ petition by drawing reference to RSO 24A. It is, however, open to the District Collector to consider whether any appropriate land is available for grant of long term lease or on temporary occupation basis to the petitioner in terms of RSO 24A. To facilitate this exercise, the petitioner shall identify such land and communicate the same to the third respondent. Within two months from the date of request for grant of temporary occupation or long term lease, the third respondent shall pass orders on merits and in accordance with law.
4. With the above observations, the writ petition stands disposed of without any order as to costs. Consequently, connected miscellaneous petition is closed.
