Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 3 to take appropriate action against the 7th respondent by considering representation dated 28.10.2024 made by the petitioner as per law. ORDER
This writ petition is filed to direct the respondents 1 to 3 to take appropriate action against the 7th respondent by considering representation dated 28.10.2024 made by the petitioner, as per law.
2. By consent of both the parties, this writ petition is taken up for final hearing at the stage of admission itself.
3. The case of the petitioner is that the petitioner was appointed as B.T.Assistant (Maths) on 08.07.2009 by the sixth respondent. This being the case, the fourth respondent, without any authority and prior permission, approved the promotion of 7th respondent as Headmaster, which is against the conditions as per G.O.Ms.No.97, School Education dated 05.07.2001. Therefore, the petitioner made a representation dated 28.10.2024, before the Page No.2 of 5
respondents, seeking to set aside the illegal promotion of the 7th respondent as Primary School Headmaster and recover the received benefits by taking criminal action. However, the said representation was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submits that, it would suffice, if this Court, issues a direction to the third respondent to consider the petitioner's representation dated 28.10.2024, as expeditiously as possible.
5. Learned Special Government Pleader appearing for the respondents submits that, the petitioner's representation dated 28.10.2024 will be considered and appropriate orders will be passed within a time frame that may be stipulated by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the third respondent to consider the petitioner's representation dated 28.10.2024 and pass Page No.3 of 5
appropriate orders, on merits and in accordance with law, within a period of six
(6) weeks from the date of receipt of a copy of this order.
