O R D E R
These writ petitions have been filed seeking a direction to the first respondent to act upon the applications submitted by the petitioners on different dates, wherein the petitioners have sought for service connection for their residential premises.
2. Heard the learned counsel for the petitioners, the learned Standing counsel appearing for the first respondent and the learned Government Advocate appearing for the second respondent and perused the materials available on record.
3. The learned counsel for the petitioners submits that the petitioners are in possession of the property and they have given applications for grant 3/6
of domestic electricity connection, but till date the same have not been considered.
4. Mr.L.Jaivenkatesh, learned Standing counsel accepts notice for first respondent and Mr.K.Karthikeyan, learned Government Advocate accepts notice for the second respondent.
5. The learned counsel for the Government Advocate, on instructions, would submit that the property is a temple property and the petitioners are the encroachers of the temple property.
6. Admittedly, the petitioners are in possession of the properties. Even assuming that the temple has ownership over the property and the petitioners are encroachers, it is for the respondents to proceed against the petitioner under Section 78 of the Hindu Religious and Charitable Endowments Act or by filing a civil suit. This Court is of the view that mere granting of electricity connection to a person, who is in occupation of the property for many years, will not take away the rights of the second respondent to proceed against those persons.

At this stage, learned Standing counsel for the first respondent submitted that the applications of the petitioners have already been rejected and if the petitioners give fresh applications along with necessary charges, the same will be considered and electricity connection will be provided on 4/6
executing the indemnity bond.

In view of the above, there shall be a direction to the petitioners to give fresh applications to the first respondent and on receipt of such applications, the first respondent shall consider the applications submitted by the petitioners and if the petitioners satisfy all the requirements and execute the necessary indemnify bond, the first respondent is directed to process the applications and provide service connection to the petitioners. The first respondent shall complete the above process within a period of two months from the date of receipt of a copy of this order.
9. These writ petitions are disposed of with the above directions. There shall be no order as to costs.
