O R D E R

The petitioner apprehends arrest at the hands of the respondent police for the offence under Section 6(4) of TN Scheduled Commodities (RCDS) Order, 1982 r/w Section 7(1)(a)(ii) of the Essential Commodities Act, 1955 in Crime No.403 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner, ranked as A2, collected 4250 kgs of rice meant for the public distribution system from beneficiaries. While the rice was being transported to Kerala, the vehicle was intercepted at the border and the driver was arrested with the rice. Based on the statement recorded from the driver, the petitioner has been added as an accused.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that the petitioner has not involved in this case and only based on the confession statement of the driver, the petitioner has been added as an accused in this case and that the property has been seized. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent/State reiterated the prosecution case and upon instructions submitted that the petitioner is not having previous cases however, the contraband seized in this case is huge quantity and that the investigation in this case is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case; and taking note 2/4

of the submission made by the learned Government Advocate (Crl.Side); and though no previous bad antecedents has been registered considering the fact that huge quantity of rice meant for public distribution system has been recovered and the investigation in this case is still pending and if the petitioner is enlarged on bail at this state, he would indulge in similar offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 11.12.2025 ssi To:
