Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents not to permit to conduct weekly Monday market at Hospital Road, Maduranthakam consequently directing the respondents to conduct the weekly Monday market at Uzhavar Santhai Building at Maduranthakam or any other place at Maduranthakam, Chengalpattu District. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This writ petition has been filed by the petitioner seeking

issuance of direction to the respondents to prohibit the weekly Monday market operated at Hospital Road, Maduranthakam. A prayer is also made to conduct the weekly Monday market at Uzhavar Santhai Building at Maduranthakam or any other place at Maduranthakam.

3. Both the prayers cannot be allowed. In the absence of any prohibition to conduct the weekly Monday market at the place where it is being done, we cannot issue such blanket direction. During the course of argument, though there is no specific pleading in this regard, learned counsel for the petitioner submits that when weekly Monday markets are conducted in the area stated in the petition, there is serious traffic congestion, parking spaces are occupied and even it becomes difficult to enter the hospital which affects access to the health care.

4. Learned Standing Counsel appearing for the fourth respondent/Municipality assures the Court that while permitting to conduct the weekly Monday market, issues relating to traffic congestion, illegal occupation of parking spaces and entry into the hospital and other places shall be dealt with so that the aforesaid difficulties are taken care of.

5. Placing on record the said statement, the writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.

A copy of this order may be placed before the Commissioner, Maduranthakam Municipality and the Inspector of Police, Maduranthakam for necessary compliance.
