Respondents Prayer: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, seeking to punish the respondent Nos.1, 2 and 3 for wilful and blatant disobedience of the judgement of this Court dated 13 August 2025 passed in W.P. No.27390 of 2025.

ORDER
This Contempt Petition has been filed alleging wilful disobedience of the order passed by this Court on 13.08.2025 in W.P. No.27390 of 2025.
2. Learned counsel for the petitioner submitted that the petitioner had earlier filed the writ petition viz., W.P. No.27390 of 2025 challenging clause 2.2.1(f) of the tender conditions. This Court, by its order dated 13.08.2025, while considering the said challenge, made an observation that it is open to the petitioner to submit a bid and that such bid shall be received by the second and 2/4
third respondents and the same would be dealt with strictly in accordance with law.
3. He further submitted that pursuant to the said order passed by this Court, the petitioner submitted the tender. However, according to the petitioner, the bid submitted by the petitioner was not accepted by the respondents and thereafter the tender itself came to be cancelled. Aggrieved by the said action and subsequent developments, the petitioner has again filed another writ petition in W.P. No.123 of 2026 challenging the action of the respondents and in the said writ petition, arguments are completed and awaiting for orders.

In view of the above factual position and inasmuch as the grievance of the petitioner with regard to the non-acceptance of the bid and cancellation of the tender is the subject matter of consideration in the subsequent writ petition, this Court is of the view that no case of wilful disobedience of the order dated 13.08.2025 is made out so as to proceed further in the present Contempt Petition. Accordingly, the Contempt Petition is closed. Consequently, connected Sub Application is also closed.
