ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.10.2025 for the alleged offence punishable under Sections 123, 278 BNS r/w Section 77 JJ Act, in Crime No.263 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner is ranked as A1. It is alleged that the petitioner joined hands with other accused was involved in the transportation and possession of 600 nos. of tapentadol tablets. During the course of investigation, it was revealed that these tablets were used for intoxication after being mixed with sterile water and also by injection. Hence, a complaint was lodged and the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 29.10.2025. He further submitted that the property was recovered. Hence, he prayed to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that there are totally two accused in this case and the petitioner is ranked as A1. He

further submitted that the petitioner is having three previous cases, out of which, two cases are of NDPS Act. He further submitted that the petitioner went to the Mumbai and brought the tablets on the instigation of other accused and that the investigation is pending. Hence, he opposed to grant bail to the petitioner.

5. Considering the submissions made by the learned counsel on either side, the gravity of the offence, though it is stated that the petitioner has three previous cases, of which, two cases are related to NDPS Act, this Court is not inclined to grant bail to the petitioner.
