ORDER
The present Writ Petition has been filed challenging the impugned refusal checkslip dated 12.11.2025 issued by the 4th respondent, rejecting the candidature of the petitioner to the post of Constable (GD).
2. It is the case of the petitioner that, the petitioner having participated in duly notified recruitment process pursuant to the notification dated 05.09.2024 issued by the Staff Selection Commission, to the post of Constable (GD) under OBC category, his candidature to the said post was rejected vide impugned rejection check slip dated 12.11.2025. Aggrieved by which, the present Writ Petition has been filed.
3. Learned counsel appearing for the petitioner submitted that the impugned rejection Check Slip issued by the 4th respondent is wholly arbitrary and illegal, as it has been issued without any basis and does not disclose any reasons for rejection and therefore, the same is liable to be set aside. Accordingly, he prayed for allowing the Writ Petition.
4. Learned Additional Government Pleader appearing for the respondents submitted that the petitioner participated in the duly notified recruitment process under the MBC (Men) category and the cut off marks prescribed for the said category was 77.62 marks whereas the petitioner had scored only 67.25 marks which is below the prescribed cut off marks. Hence, the petitioner having failed to qualify the examination by securing the minimum prescribed cut off marks, is not entitled to challenged the rejection. Accordingly, he prayed for dismissal of the Writ Petition.
5. Heard the learned counsel appearing on either side and perused the materials available on record.
6. The petitioner has challenged the rejection slip issued by the 4th respondent, whereby, his candidature for the post of Constable (GD) pursuant to the recruitment notification dated 05.09.2024 has been rejected on the ground that no reasons were assigned therein. It is not in dispute that the cut off marks prescribed for the MBC (Men) Category is 77.62 marks whereas, the petitioner has, admittedly, secured only 67.25 marks which is below the minimum cut off marks required for selection. In such circumstances, this Court is of the considered opinion that, the petitioner, having failed to secure the minimum qualifying marks, cannot challenge the consequential rejection of his candidature. Therefore, the contention of the petitioner that no reasons have
been disclosed in the impugned check slip as to the rejection of candidature does not merit acceptance and this Writ Petition is liable to be dismissed.
7. For the reasons aforesaid, the Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
