ORDER
The present writ petition has been filed to direct the respondents to disburse the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01/07/2023 with interest at the rate of 8 percent per annum from the said date of entitlement to till the date of actual disbursement.

The learned counsel appearing for the petitioner would submit that the petitioner joined the 1st respondent Transport Corporation as Junior Trademan on 06.05.1992, his services were regularised with effect from 08.01.1993, thereafter, the petitioner was working as Selection Grade Tradesman at R.C.Unit, Vellore Region and retired from service on 31.7.2023. It was the further submission of the learned counsel for the petitioner that the petitioner was granted Dearness Allowance for the Transport Employees at the rate of 42% of the Basic Pay as on 01.04.2023, however, the same was revised to 46% of Basic Pay with effect from 01.07.2023. Therefore, he would submit that while calculating the retirement benefits the increase of 4% has to be taken into account while calculating the petitioner's retirement benefits. However, the petitioner was disbursed with the retirement benefits at the then prevailing rate of Dearness Allowance i.e., 42%.
3. Aggrieved by the same, the petitioner submitted a representation to the 2/4
respondents on 15.09.2025 requesting the respondents to disburse the differential payment with interest at the rate of 8% per annum for the said belated payment. Since, the same has not been considered by the respondents till date, the petitioner has filed the present writ petition seeking appropriate direction to the respondents to consider the representation dated 15.09.2025.

In view of the limited request made by the learned counsel for the petitioner, this Court is inclined to issue a direction to the respondents to pay the differential pay with interest @ 6%, if the petitioner is entitled, by considering the petitioner's representation dated 15.09.2025 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
