ORDER

(Order of the Court was made by the Hon'ble Chief Justice) What has brought the petitioner to this court, despite pendency of an application before the Debts Recovery Tribunal (for short, 'the DRT'), is that the petitioner, though has filed stay petition, the same has remained pending since many months.

2. We also find that there is an issue of delay which is also pending consideration before the DRT. On the issue of condonation of delay and the stay application, the DRT has to take a decision one way or the other at the earliest possible time.

3. At this stage, learned counsel for the petitioner would submit that the case is listed for arguments before the DRT on 24.12.2025.

4. We would not comment upon the merits of the case, as the matter is pending before the Debts Recovery Tribunal, except to

observe that interim applications should be decided at the earliest.

5. The petition stands disposed of. There will be no order as to costs. Consequently, WMP No.5387 of 2025 is closed. (MANINDRA MOHAN SHRIVASTAVA, CJ.)
