O R D E R

The petitioners, who apprehend arrest by the respondent police for the offences punishable under Sections 147, 447 of IPC r/w 3 of TamilNadu Public Property (Prevention of Damage and Loss) Act 1992, in Crime No.210 of 2024 registered on the file of the respondent police, seek anticipatory bail.

The allegation against the petitioners is that they joined with other accused entered into the premises of the defacto complainant and, due to property dispute, damaged the standing trees and also closed down the well, causing damage to the tune of Rs.6,00,000/-. Hence, a case have been registered against the petitioners.

3. The learned counsel for the petitioners submitted that due to property dispute, a false complaint has been lodged against the petitioners. He further submitted that the petitioners have not committed any offence as alleged by the prosecution and that they are ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal side) for the respondent police reiterated the prosecution case and submitted that the damage caused is of huge value and includes the well used for irrigating the agricultural land. Hence, she opposed to grant anticipatory bail to the petitioners.

5. Considering the allegations that the petitioners not only damaged the trees and plants but also caused damage and closed down the well used 2/4

for irrigation purposes, this Court is not inclined to grant anticipatory bail to the petitioners.
