ORDER

(Order of the Court was made by N. SATHISH KUMAR, J.) This application has been filed by the plaintiff in T.O.S.No.36 of 2019 to receive additional documents on their side in the said Testamentary Suit. 2.It is the contention of the applicant that these documents were already exhibited before the trial Court as additional documents in Ex.B-Series in O.S.No.274 of 1999 on the file of the II Additional Sub-Court, Gobichettipalayam and these documents are relevant to show the reasons for bequeathing extra properties to the plaintiff. 3.Though we are of the view that these documents may not be relevant to decide the prayer, but the fact remains that these documents are already on record in the suit in O.S.No.274 of 1999 and the appeal as against the judgment and decree in the said suit should also be disposed of simultaneously. In such view of the matter, no prejudice, whatsoever, would be caused to the respondent

in just receiving the documents.

4.Accordingly, this application is ordered and the additional documents sought to be received shall be received subject to proof and relevancy. 5.Post the suit in T.O.S.No.36 of 2019 before the learned Additional Master-I for recording evidence, on 02.02.2026. All the plaintiff's side witnesses shall be examined within a week and the defendant's side evidence shall be completed within a week thereafter.
