It appears that there is a mistake crept in the registry. Though Letters of Administration granted in favour of the petitioner has been revoked in the year 2006, the Original Petition has not been converted to suit. Still it is retained as the Original Petition.

2. In the meanwhile, the first petitioner died on 07.09.2016 and the application filed by the Legal representatives has been returned on the ground that the Original Petition has to be converted as suit.

3. The registry ought to have converted the Original Petition to suit immediately when the Letters of Administration granted by this Court has been revoked. However, the same has not been done. Hence, the registry is directed to convert the Original Petition to Testamentary Suit and issue Form 70.
