The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) read with Section 22(b), 23(b), 29(1) of NDPS Act in Crime No.286 of 2025, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioner is that based on the secret information received by the respondent police on 20.11.2025 at about 23.20 hrs, the defacto complainant and others went to Ulli Kootraod for vehicle checkup, at that time, when they searched A1 & A2, they found that, they were in possession of 2 pockets of Methamphetamine each 1.50 grams totally 3 grams and based on the confession statement, the petitioner/A3 was implicated in this case and the investigation revealed that, petitioner has supplied the methamphetamine to other accused. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the investigation is pending. Hence, he prayed for dismissal of this petitioner.
5. Though, it is stated that the seized quantity is an intermediate quantity, considering the fact that, if the petitioner is granted anticipatory bail, there is a likelihood that the petitioner will commit similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.
