ORDER

This writ petition has been filed challenging the impugned order dated 01.09.2025 passed by the third respondent rejecting the petitioner's application for issuance of patta for the property morefully described in the affidavit filed in support of this writ petition.

2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the fourth respondent, notice to the fourth respondent in this writ petition is dispensed with.

3. As seen from the impugned order rejecting the petitioner's application seeking for issuance of patta, no reasons have been given by the third respondent while rejecting the petitioner's application. Being a non-speaking order, necessarily, the impugned order will have to be set aside and the matter will have to be remanded back to the third respondent for fresh consideration. The petitioner also contends that the suit which was earlier pending has now been dismissed for default, and the same has not been considered by the third respondent while considering the petitioner's application seeking for issuance of patta.

For the foregoing reasons, the impugned order passed by the third respondent is hereby quashed, and the matter is remanded back to the third respondent for fresh consideration, on merits and in accordance with law, within a time limit to be fixed by this Court. Accordingly, the third respondent is directed to pass final orders on merits and in accordance with law, after giving due consideration to the petitioner's application seeking for issuance of patta as well as supporting documents and after hearing objections from the fourth respondent and any other party whom the third respondent deems fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. With the aforesaid directions, this writ petition is disposed of. No Costs. Connected W.M.P.No.54169 of 2025 is ordered.
