Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Certiorarified Mandamus calling for the records of impugned letter of the respondent calling for the particulars to draw panel for the panel year 2025-2026 to the post of Motor Vehicles Inspectors (Non-Technical) from the post of Superintendent of R.No.11784/ RA1/ 2025 date 27.11.2025 and quash the same and consequently direct the respondent herein to include the name of the petitioner in the panel of superintendent fit for promotion as Motor Vehicles Inspectors (Non-Technical) for the panel year 2025-2026 at appropriate place with the seniority and all other consequential benefits. 1/6

ORDER

This Writ Petition has been filed challenging the letter of the respondent calling for particulars to draw panel for the panel year 2025-2026 to the post of Motor Vehicles Inspectors (Non-Technical) from the post of Superintendent of R.No.11784/ RA1/ 2025 date 27.11.2025 and quash the same and consequently direct the respondent herein to include the name of the petitioner in the panel of superintendent fit for promotion as Motor Vehicles Inspectors (Non-Technical) for the panel year 2025-2026 at appropriate place with the seniority and all other consequential benefits.

2.The facts in nutshell are as follows (i) The petitioner herein was appointed as Typist and his services were regularized and subsequently he was promoted to the post of Assistant and Superintendent. Now the petitioner held the post of Superintendent at RTO 's office Ranipet. The petitioner was issued with memo of charge for non taking continuous action in the file bearing No.39893/B2/2019 of Regional Transport Office, Ranipet on the subject of issuance of fake driving licenses during the period between 2017-2017 using user id and password of Tr.Mohan the Motor

Vehicles Inspector and Tmt.R.Sridevi Jayanthi Superintendent, for which the petitioner submitted his explanation and the memo of charge was cancelled by the respondent.

(ii) The petitioner was not included in the panel for the years 2016-2017 to 2022-2023. The petitioner has submitted representations dated 16.08.2024 and 02.06.2025, which was not considered. Subsequently, the respondent vide the impugned letter called for the particulars to draw panel for the year 20252026 to the post of Motor Vehicles Inspectors [Non Technical] from the post of Superintendent in R.No.11784/RA1/2025 dated 27.11.2025. The Annexure-A, the tentative seniority list was published in the above letter, in which the petitioner's name was not found. Challenging which the present writ petition has been filed.

Learned counsel appearing for the petitioner would submit that though there is no charge memo or disciplinary proceedings pending against the petitioner crucial date of drawing of panel for the aforesaid years, the respondent has failed to include the name of the petitioner in the seniority list and that apart the respondent without passing orders on the representation of the petitioner has issued the impugned letter. He therefore prays to set aside the same.

The learned Additional Government Pleader appearing for the respondent would submit that since the charges under Rule 17(b) of TNCS (D & A), was framed against the petitioner, his name was not included in the regular panel to the post of Superintendent from the year 2016-17 and the charges framed against him was cancelled on 27.07.2024. Further, he would submit that the petitioner has not completed the service norms stipulated under Rule 30(b) of Special Rules for Tamil Nadu Ministerial Service i.e., one year period of service as an Accountant in any one of Regional Transport Office and 2 year period of service as an Assistant in any one of the office viz., STA, JTC, DTC, STAT, Internal Audit Wing, on the crucial date of preparation of the panel to the post of Superintendent for the year 2016-2017 viz., 15.03.

2016 but completed only on 17.05.2017. Therefore, a proposal is being prepared to relax rule 30(b) of the Special Rules for Tamil Nadu Ministerial Service in favour of Thiru.K.Ravi, Superintendent (temporarily promoted) as as to include his name at Sl.No.40A below the name of Thiru.N.Perumal (Sl.No.40) and above the name of Tmt.Hemalatha (Sl.No.41) in the panel of Assistants fit for promotion to the post of Superintendent for the year 2016-2017 approved in Transport Commissioner's proceedings R.No.11361/RA2/2016 (E.O.No.86/2024) dated 19.02.

Inspector (Non Technical). He has also filed a report to that effect.

5. Recording the submissions made by the learned Additional Government Pleader appearing for the respondent, this Writ Petition is disposed of. The respondent is directed to include the name of the petitioner in the panel of Assistants fit for promotion to the post of Superintendent for the year 20162017. within a period of twelve weeks from the date of receipt of necessary orders from the Government. No costs. Consequently, connected Miscellaneous Petitions are closed.
