No.48132 of 2025 : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of mandamus directing the respondents to pay interest to the petitioner at the rate of 8 percent per annum for the belated payment of his Provident fund, Earned Leave Salary and Gratuity Amount within a time limit to be stipulated by this Court. COMMON ORDER These writ petitions have been filed to direct the respondents to pay interest at 8% per annum for the belated payment of Provident Fund, earned leave salary and Gratuity amount to the petitioners. 2/6

It is the case of the learned counsel for the petitioners that the petitioners joined the services of respondent Corporation as Driver and Junior Clerk on 24.04.1987 and 17.02.1987 respectively and after rendering continuous service of 35 years and 37 years, the petitioners retired from service on 31.01.2023 and 30.04.2024 respectively. It is further stated by the learned counsel for the petitioners that surrender leave salary, gratuity, provident fund, earned leave salary were belatedly paid to the petitioners only on 01.11.2024 and 25.08.2025 respectively. Therefore, the petitioners submitted a representation to the respondents on 24.09.2025 seeking payment of interest for the belated settlement of retirement benefits, however, the same has been kept pending till date. Aggrieved, the petitioners have filed these writ petitions.

3. Heard the learned counsels appearing on either side and perused the materials available on record.

In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest @ 6% for the belated payment of retirement benefits from the date of retirement till the date of actual disbursal of retirement benefits of the petitioners, within a period of six weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits. 3/6

5. Accordingly, these Writ Petitions are disposed of. There shall be no order as to costs.
