ORDER
This Writ Petition (Crl.) has been filed seeking a direction to the respondents 1 to 4 to conduct a detailed enquiry by considering the petitioner's representation dated 29.11.2025 and initiate appropriate action.
2. Today, when the matter was taken up for hearing, the learned counsel for petitioner would submit that the petitioner is a construction company and they are inducted in laying storm water drainage project near Ramapuram Main Road. While so, on 27.09.2025 somebody had committed theft of 66 ductile iron grating worth of Rs.2,11,200/-. Hence, the petitioner had given a complaint on 03.11.2025. Subsequently, while verifying CCTV footage, it was found that the theft was committed by one K. Rajesh. Whereas the respondents have not conducted a proper investigation and not taken any action against the said Rajesh.
3.Per contra, learned Additional Public Prosecutor appearing for respondents 1 to 4 would submit that based on the complaint given by the petitioner dated 03.11.2025 as if some persons had committed theft of 66 ductile iron grating, a case in crime No.349 of 2025 was registered for an offence under Sec.303 (2) of B.N.S. He would further submit that since the petitioner has not named any person in his complaint, the name of the accused was not mentioned in the F.I.R. Further, he would submit that only later, by representation dated 29.11.2025, the petitioner had given a piece of information about one Rajesh. __________Page 2 of 4
He would further submit that due enquiry would be conducted and if necessary, the said Rajesh will be added as an accused in the F.I.R. and proper investigation will be conducted.
4. Recording his submissions, this Writ Petition (Crl.) stands disposed of. No costs.
