The present Writ Petition (Criminal) has been filed seeking a direction to the second respondent to take necessary action to dispose of the petitioner's application dated 05.07.2025, based on the communication from the 1st respondent in Letter No.e-4116/Police-VIII/2025-1, dated 27.07.2025, within a stipulated time.
Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of respondents 1 & 2.
In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the admission stage itself. Notice to the third respondent is dispensed with inasmuch as no order prejudicial to his interest is passed. 4.
When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for respondents 1 & 2 submitted that the petitioner had earlier filed a writ petition before this Court in W.P.No.1532 of 2023, seeking appropriate action against the third respondent herein, alleging mala fide prosecution. This Court, vide order dated 06.02.2025, dismissed the said writ petition. Aggrieved by the same, 2/5
the petitioner preferred an appeal in W.A.No.1179 of 2025 and a Division Bench, vide order dated 16.04.2025, confirmed the order dated 06.02.2025 passed in W.P.No.1532 of 2023. However, he submitted that the representation of the petitioner dated 05.07.2025, seeking action against the third respondent will be considered on merits at the earliest. 5.
Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, this Court directs the second respondent to dispose of the petitioner's representation dated 05.07.2025, in accordance with law, taking into consideration the order dated 06.02.2025 passed by this Court in W.P.No.1532 of 2023 and the judgment dated 16.04.2025 passed in W.A.No.1179 of 2025, within a period of four weeks from the date of receipt of a copy of this order. 6.
With the above directions, this Writ Petition (Criminal) stands disposed of. No costs.
