..Respondent(s) To direct the learned Sub Ordinate Judge Court Ambattur to dispose the IA No.7 of 2025 in OS No.1255 of 2023 dated 21.08.2025 filed by the petitioners/3 & 4th defendants under order VII Rule 11 read with Section 151 of CPC praying to reject the plaint filed by the 1st and 2nd respondents /plaintiffs in O.S No. 267 of 2013 in the learned Subordinate Judge Court Poonamallee, which has been transferred and pending on the file of OS No. 1255 of 2023 in the learned Subordinate Judge Court Ambattur within the time to be stipulated by this Hon'ble Court.

To stay the further proceedings of the OS No. 1255 of 2023 pending in the learned Sub Ordinate Judge Court Ambattur pending disposal of the above CRP.

ORDER

This Civil Revision Petition has been filed to direct the learned SubOrdinate Judge Court Ambattur, to dispose the IA No.7 of 2025 in OS No.1255 of 2023 dated 21.08.2025 filed by the petitioners/3 & 4th defendants under order VII Rule 11 read with Section 151 of CPC praying to reject the plaint filed by the 1st and 2nd respondents /plaintiffs in O.S No. 267 of 2013 on the file of the learned Subordinate Judge Court Poonamallee, within a time frame as fixed by this Court.

2.The learned counsel for the petitioner would submit that in the original plaint in O.S. No.267 of 2013, the plaintiffs/the respondents 1 and 2 herein had fraudulently made dishonest claim by suppressing the fact of former suit by falsifying the fact that the plaint schedule A property, Item No.2 eastern boundary is Road (Park Road) and the plaint schedule B property Item No.2, the eastern boundary is Road (later known as Park Road). Further, in the 2nd amended plaint in O.S. No.267 of 2013, the plaintiffs/the respondents 1 and 2, had made false entry that the relief claimed for Declaration of Title and recovery possession of the suit property is properly valued and the Court fee was paid at Rs.12,14,200/- Since the plaintiffs have not approached the Court

with clean hands and are guilty of fraud, suppression of facts and misrepresentation, they are not entitled for any relief. Hence, the petitioners have filed I.A. No.7 of 2025 to reject the plaint. However, the said Interlocutory application is pending before the Trial Court for disposal. Hence, this Court may direct the Trial Court to dispose of the case by fixing the time schedule as deemed fit.

3. Having considered the facts and circumstances of the case and submissions made by the learned counsel for the petitioners, the Trial Court is hereby directed to dispose of I.A. No.7 of 2025 filed by the petitioners after vacation period on or before 30.06.2026 without any further delay in accordance with law.

4. With the aforesaid directions, the Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 21-04-2026 Index: Yes/No Speaking/Non-speaking order Lbm
