ORDER

The Civil Revision Petition is filed challenging the Docket order dated 18.07.2025 made in Oder No.10 in Case No.OA.(II-U)/MAS/02/2025) On the file of Railway Claims Tribunal, Chennai Bench.

2. Copy of typed set of papers served. None appeared on behalf of respondent.

3. Before the Railway Claims Tribunal, the learned counsel for the claimant had filed a memo seeking to summon the Investigation Officer with regard to the information available in the Inquest report and final report. However, the Tribunal declined such permission, stating that there was no scope for any further clarification. Consequently, the petitioners' request was rejected. Aggrieved by the same, the present revision has been filed.

4. The revision petitioners are the legal heirs of the deceased; an unmarried son, died in an untoward railway accident while travelling in a train. In respect of the claim, they sought to summon the Investigation Officer, which is just and necessary for proper adjudication. However, such an opportunity was not afforded to the claimants before the Tribunal, thereby affecting their valuable right to effectively establish their case and claim compensation.

5. In view of the above, the impugned order is set aside, and the claimants are permitted to issue summons to the Investigation Officer, as prayed for. The Railway Claims Tribunal is directed to proceed with the matter and dispose of the case as expeditiously as possible, preferably within a period of eight weeks.

6. In the result, the civil revision petition is disposed of accordingly. No costs.
