PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records on the file of the 3rd respondent made in Na.Ka.No.1577/A1/2022

dated 26.12.2024 and proceedings issued in Na.Ka.1421/A1/2022 dated 07.11.2025 and quash both and consequently direct the respondents to reinstate the petitioner in service as a Supervisor and to further direct the respondents to reimburse a sum of Rs.67,00,000/- from and out of Rs.1,41,10,675/- which was force fully collected from the petitioner. O R D E R

This Writ Petition has been filed challenging the order dated 26.12.2024 suspending the petitioner from service and also the order dated 07.11.2025, demanding payment from the petitioner and for a consequential direction to the respondents to reinstate the petitioner in service as a Supervisor and to further direct the respondents to reimburse a sum of Rs.67,00,000/- from and out of Rs.1,41,10,675/- which was force fully collected from the petitioner.

2. The learned counsel appearing for the petitioner would submit that the petitioner joined as a Supervisor on consolidated pay of Rs.3,000/- per

month with effect from 01.01.2004 in the respondent Corporation on 04.02.2004 and have rendered an unblemished and sincere service. While so, when he was working as Supervisor in the TASMAC retail shop No.4601, which is functioning at Vivara Mall, Navalur, Tiruporur Taluk, Kanchipuram South District, the 3rd respondent visited the shop and verified the stock thereafter, it was alleged that a sum of Rs.1,41,10,675/- was misappropriated by the staff of the retail shop thereby, the petitioner was placed under suspension and in respect of the petitioner alone, the respondents collected Rs.67,00,000/-. He would further submit that after collecting the said amount, placing the petitioner under prolonged suspension is not acceptable one. On the sole ground, the present writ petition is filed.

3. The learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to conclude the disciplinary proceedings as against the petitioner, after providing reasonable opportunity to the petitioner within a specified time.

4. The learned Government Advocate appearing for the respondents would submit that the respondents will conclude the disciplinary proceedings as against the petitioner, after providing reasonable opportunity within a period of four months.

5. In view of the same, there will be a direction to the respondents to conclude the disciplinary proceedings as against the petitioner within a period of four months from the date of receipt of a copy of this order. If the disciplinary proceedings held in favour of the petitioner, the respondents shall revoke the suspension order. Till such time, the respondents shall not demand any amount from the petitioner.

6. In view of the same, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 05.01.2026 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No kkn
