The present Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.3803 of 2020, pending on 1/4

the file of the first respondent police, on the basis of the compromise arrived at between the petitioners and the de facto complainant/second respondent. Learned counsel appearing for the petitioner submitted that the matter arises out of a civil dispute and that on the advice of elders, the parties have now amicably settled the issue among themselves. Hence, they seek to quash the proceedings pending against the petitioners. Affidavits and a Joint Compromise Memo to that effect have also been filed. 3.

Learned Government Advocate (Criminal Side) submitted that based on the complaint given by the second respondent/de facto complainant, the case in Crime No.3803 of 2020 was registered for the offences under Sections 294(b), 324, 307 and 506(II) of IPC. He further submitted that this is a case in which the victim sustained grievous injuries. He also submitted that apart from the above fact, the first petitioner herein has three previous cases, out of which, two were registered for the offence under Section 307 IPC and one is for 397 IPC and two cases are registered under Section 397 IPC. He further submitted that as far as the second petitioner is concerned, three previous cases are pending, out of which, one is registered under Section 307 IPC. Hence, he objected for quashing the First Information Report against the petitioners. 2/4

Having heard the learned counsel appearing on either side and upon careful consideration of the previous cases pending against the petitioners and the nature of injuries sustained by the victim, this Court finds no ground in this petition and hence, is not inclined to exercise its powers under Section 482 Cr.P.C.(corresponding to Section 528 BNSS) to quash the First Information Report on the basis of the compromise arrived at between the parties.

Accordingly, this Criminal Original Petition stands dismissed. 05.01.2026 ham To 1.
