O R D E R

The petitioner was arrested on 19.08.2025, on execution of NonBailable Warrant issued by the District Munsif cum Judicial Magistrate, Pochampalli, for the offence under Sections 308, 457 of IPC, pending trial in C.C.No.100 of 2020 in Crime No.126 of 2016 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he was involved for the offence under Sections 308, 457 of IPC. Earlier, the petitioner was arrested and subsequently released on bail. Thereafter, due to his non-appearance before the Trial Court, a Non Bailable Warrant was issued against him. Pursuant to the same, the petitioner was arrested under a P.T Warrant on 19.08.2025.

3.The learned counsel appearing for the petitioner would submit that in the month of May 2025, this petitioner was arrested in connection with Crime No.91 of 2025 on the file of Othakadai Police Station and therefore, he was not able to appear before the Trial Court in the present case. Due to the said non-appearance a non-bailable warrant was issued against him. Even thereafter, the arrest of the petitioner in the other case was not reported to the concerned Court. Subsequently, a P.T. Warrant was issued, pursuant to which the petitioner was produced before the Trial Court and remanded to judicial custody on 19.08.2025. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner was earlier arrested and released on bail and had appeared before the Trial Court. However, thereafter, he became involved in another offence and was taken into custody. During that period, he failed to appear before the concerned Court in the present 2/4

case, which resulted in the issuance of a non-bailable warrant. Subsequently, upon intimation that the petitioner was in custody in another case, a P.T. Warrant was issued and executed, and the petitioner was produced before the Trial Court.

This Court on perusal of the order passed by the Madurai Bench of this Court in Crl.OP(MD).No.17406 of 2025, filed by the petitioner in connection with Crime No.91 of 2025, wherein it is stated that the petitioner was involved in yet another offence in the month of May 2025. It is also stated that the petitioner is involved in 47 cases, and each cases are pending at different stages.

Considering the bad antecedents of the petitioner and the fact that the petitioner is involved in another offence, this Court is not inclined to grant bail, at this stage, as there is every likelihood of the petitioner indulging in similar activities and failing to appear before the Trial Court. 7.
