Mr. S. Yashwanth, AGP Additional Government Pleader Judgment (Judgment of the Court was delivered by R.Suresh Kumar J.) This writ appeal has been preferred against the order dated 19.09.2024 made in W.P.No.25883 of 2019.

2. The respondent / writ petitioner entered into service as Driver in the appellant Department on 21.06.1999. He completed 10 years of service on 23.06.2009 and 20 years of service on 23.06.2019. On completion of ten years and twenty years of service, the benefit of selection grade and special grade have to be conferred. This position has been reiterated in G.O.Ms.No.65 dated 26.02.2011.

3. When similar issue came up before the writ Court in W.P.No.25930 of 2013 filed by one M.Venkatesh, that writ petition was allowed in the teeth of G.O.No.65 by order dated 18.06.2014. The said order admittedly has been accepted and implemented by the Department concerned.

4. In the present case, the learned Judge who passed the order which is impugned herein, has followed the aforesaid judgment of the writ Court dated

18.06.2014 in the case cited supra in W.P.No.25930 of 2013. The said judgment since has been accepted and implemented and no appeal has been preferred against the said order, we cannot take a different view than the view already been taken in the aforesaid W.P.No.25930 of 2013 and there cannot be a deviating stand in respect of the present respondent / writ petitioner alone. Hence, the reasoning given and the conclusion arrived at the learned Judge through the impugned order cannot be said to be infirm.

5. Therefore, we are not inclined to entertain this appeal, resultantly the writ appeal fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed. The direction given by the Writ Court through the impugned order shall be implemented by the appellant Department within a period of two months from the date of receipt of a copy of this order.
