ORDER

This writ petition has been filed seeking a direction to the respondents to allot plot No. 136A in Phase VIII, Hosur Housing Unit, to the petitioner on payment of the value already fixed by the respondents.

According to the petitioner, on 09.05.2013, he was allotted a flat bearing HIG(I) Flat No.61 (Ground floor) at 'A' Jettihalli, Dharmapuri, by the Tamil Nadu Housing Board under a hire-purchase scheme, and a provisional allotment order was issued on 24.05.2013. Subsequently, the second respondent published a notification dated 27.05.2018 pertaining to the new scheme for allotment of individual house plots. The petitioner, along with similarly placed persons, challenged the said notification in W.P.Nos.13189 to 13194 of 2018. Simultaneously, the petitioner also filed a writ petition in W.P.No.7510 of 2018 and this Court, by order dated 20.12.2021, directed the respondents to consider the petitioner for allotment of the flat/plot in the new scheme or in the existing scheme. The petitioner has given representations on

22.09.2025 and 03.10.2025 seeking allotment of vacant plot No.136A, Phase VIII, Hosur Housing Unit, but the same has not been considered. Hence, the petitioner has come up with the present writ petition.

3. The learned Standing Counsel appearing for the respondents, on instructions, would submit that the upset price has already been fixed by the Housing Board. If the petitioner is willing to deposit the amount fixed by the Housing Board, the petitioner's case will be considered. According to them, upset price has been fixed at Rs.11,13,39,000/- for the Plot No.136A , for an extent of 31749 sq.ft. in HOS 066.

4. The learned senior counsel appearing for the petitioner would submit that the petitioner is willing to deposit the said upset price fixed by the respondents.

5. In such view of the matter, though the respondents are now willing to execute the sale deed on deposit of the upset price, considering the fact that the amount is more than Rupees Ten Crores, this Court is inclined to give four months time to deposit the said amount.

6. Accordingly, the petitioner is directed to deposit the said amount within a period of four(4) months from the date of receipt of a copy of this order. On such deposit, the respondents shall execute the sale deed in her favour within a period of one month thereafter.

7. With the above directions, this writ petition is disposed of.
