ORDER

(Order of the Court was made by Dr. G.Jayachandran J.) The Public Interest Litigation, seeking a mandamus to remove the encroachment in public Pathway at Vennaiyamman Koil Street, Bommaiyar Palayam (South), Kottakuppam Post, Vanur Taluk, Villupuram District, Tamil Nadu, was taken up for consideration by us after receiving report from the Tahsildar, Vanur Taluk.

2. According to the writ petitioner, the pathway more fully described in the writ petition been used by the residents for over five decades and same is the only access to their property. It is alleged that the pathway has been encroached by private individuals by placing stones and debris. Representation made to the Page Nos.2/5

District Authorities yielded no result, hence the present writ petition.

3. The Tahsildar, Vanur Taluk, Villupuram District, in his report, states that the writ petitioner is one of the occupants of the Natham land along with others. The Government thought fit to grant patta for those occupants and accordingly, around 100 pattas been issued to the occupants of the Natham land in the said survey number. There is no pathway as contended by the petitioner herein. The alleged encroachment is also an imaginary allegation. The remaining land after grant of patta are kept vacant and appropriate decisions will be taken about the said land by the authorities in accordance with law.

4. Considering the report of the Tahsildar, Vanur Taluk, Villupuram District, we find that the avements in the affidavit filed in the nature of Public Interest Litigation do not carry any public interest or factual truth.

5. Hence, this Writ Petition stands dismissed. There shall be no order as to costs.
