Criminal Revision Petitions filed under Section 438 r/w 442 of BNSS to set aside the orders dated 05.12.2025 passed in Crl.M.P. Nos. 2405 of 2025 & 2406 of 2025 respectively by the learned Principal Sessions Judge, Puducherry as illegal.

Ramachandra Murthy Additional Public Prosecutor (Puducherry) COMMON ORDER The revisions have been filed challenging the orders dated 05.12.2025 passed by the learned Principal Sessions Judge, Puducherry in Crl.M.P. Nos. 2405 & 2406 of 2025 respectively permitting the respondent to seal the premises of the respective petitioners. 2.

The allegation against the petitioners is that certain drugs, which were spurious in nature, were found in their premises. 3.

Learned Additional Public Prosecutor (Puducherry) has filed counter affidavit stating that the premises of the respective petitioners had to be sealed because the stocks that were found to be spurious were 2\4

huge. He would fairly submit that they would remove the drugs within a period of two weeks.

Learned counsel for the petitioners would submit that the respondent ought not to have sealed the premises and the learned Sessions Judge erred in directing the sealing of the premises. 5.

Admittedly, the petitioners have licence to store and sell drugs. In view of the submission made by the learned Additional Public Prosecutor (Puducherry), without going into the merits of the rival contentions, the following order is passed:

"The respondent is directed to remove the alleged spurious drugs within a period of two weeks from the date of receipt of a copy of this order and hand over the premises to the respective petitioners."

The revisions stand disposed of with the above direction. Connected criminal miscellaneous petitions are closed. 05.02.2026 nv 3\4
