ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(1A), 21(1) of Mines and Minerals (Development and Regulation) Act r/w. Section 305(e) of BNS in Crime No.690 of 2025, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner was involved
in illegally quarrying 3 units of gravel sand from Poramboke land. Hence the complaint.
3. The learned counsel for the petitioners submitted that the petitioner is innocent and has not committed the offences alleged by the defacto complainant. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side), submitted that 3 units of gravel sand has been illegally extracted from the river and the petitioner is not having any previous cases against him. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the fact that the petitioner is not only involved in quarrying river sand but also damaging the ecology and the river bed itself, this Court is not inclined to grant anticipatory bail to the petitioner and if the petitioner is granted anticipatory bail, he will involve in similar activities. Accordingly, the Criminal Original Petition is dismissed. 15-12-2025 Gbi
