ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 27.06.2025 for the offences punishable under Sections 126(2), 296(b), 103(1), 61(2) and 49 of BNS in Crime No.179 of 2025, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution is that, the deceased Balakrishnan, who is the husband of the defacto complainant had developed an illegal intimacy with 1/4

the wife of A1; that thereby there arose a matrimonial dispute between the A1 and his wife; that thereafter, A1 got enraged and conspired with other accused, paid a sum of Rs.20 lakhs to the petitioner herein, who is alleged to be a gang leader to murder the said Balakrishnan; that thereby, the petitioner along with other accused had assaulted and committed murder of the deceased. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 27.06.2025; that the petitioner was earlier detained under Act 14 of 1982 on 24.07.2025 and subsequently, the detention order was quashed; that the investigation of this case was completed and final report also filed in PRC. No.47 of 2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that there are totally seven accused involved in this case and the petitioner is arrayed as A2; that the specific overtact of the petitioner herein is that he was the leader of the gang hired for murdering the deceased for money; that the petitioner also involved in two other murder cases. 2/4

5. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.OP.No.29743 of 2025 dated 31.10.2025 after considering the case on merits.

6. Now, the learned counsel for the petitioner submitted that considering the period of his incarceration, he prays to grant bail to the petitioner. However, the learned Government Advocate (Crl.Side) submitted that the petitioner is a habitual offender and is involved in multiple criminal cases, including two murder cases, one case under the NDPS Act, and another case for the offence of attempt murder.

7. Considering the fact that the petitioner is having bad antecedents, since there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
