JUDGMENT

(Judgment of the Court was delivered by R.SURESH KUMAR, J.) It is submitted by the learned counsel appearing for the 1st respondent that, by virtue of the order passed by the Writ Court which is impugned in this appeal, retirement age has been extended from 58 to 60 and the 1st respondent was permitted to work till she superannuated at the age of 60 and after superannuation she retired peacefully from service and is getting all retiral and pensionary benefits. When that being the position, nothing survives for adjudication in this appeal, she contended. 2/4

2. The said position is not controverted by the learned counsel appearing for the appellants.

3. Therefore, in view of the aforestated where the issue has been concluded or become infructuous, no useful purpose would be served by hearing the matter further. Hence, recording the aforestated, we feel that this writ appeal can be dismissed, accordingly is dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
