ORDER

This Writ Petition has been filed seeking for a direction to the respondents 1 to 3 to consider the petitioner's appeal dated 10.11.2025 seeking cancellation of patta issued in favour of the respondents 4 and 5 for the property morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court.

2. The petitioner is aggrieved by the issuance of patta in favour of the respondents 4 and 5 for the property morefully described in the prayer to this writ petition. The petitioner therefore, seeks cancellation of the said patta. The petitioner has given a representation on 10.11.2025 to the respondents 1 to 3 seeking for cancellation of patta, presently standing in the name of the respondents 4 and 5. Since the said representation has not been considered till date, the petitioner has filed this writ petition.

3. Since no adverse order is being passed against the respondents 4 and 5, notice to the respondents 4 and 5 is dispensed with. Page No.2 of 6

4. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 3. He would submit that unless and until an online application is filed before the official respondents, as provided under the Patta Passbook Act, 1983, it will be difficult for the official respondents to consider the petitioner's representation.

5. The learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to submit an online application with the competent authority, if sufficient time is granted to the petitioner.

No prejudice would be caused to any of the respondents, if the petitioner is permitted to file an online application with the competent authority seeking cancellation of patta for the property morefully described in the prayer to this writ petition, which is presently standing in the name of the respondents 4 and 5, within a time frame to be fixed by this Court and a direction is issued to the said competent authority to pass final orders on merits and in accordance with law on the petitioner's application, after hearing the objections of the respondents 4 and 5 and Page No.3 of 6

any other third party, whom they deem fit to enquire, within a time framed to be fixed by this Court.

For the foregoing reasons, this Court directs the petitioner to submit a fresh online application with the competent authority as provided under the Patta Passbook Act, within a period of two (2) weeks from the date of receipt of a copy of this order, seeking for cancellation of patta issued in favour of the respondents 4 and 5 for the property morefully described in the prayer to this writ petition. On receipt of the said online application within the stipulated time, the competent authority shall pass final orders on merits and in accordance with law, within a period of twelve (12) weeks thereafter, after hearing the objections of the respondents 4 and 5, and any other third party, whom they deem fit to enquire.

8. With the aforesaid directions, this Writ Petition is disposed of. There shall be no order as to costs.
