ORDER
The learned counsel for the petitioner/respondent in the main Crl.R.C., would submit that on the date of admission of Crl.R.C.No.2178 of 2025 itself, the revision was allowed without notice and without giving an opportunity of hearing of the other side. He would further submit that, therefore, the
respondent in the revision filed this Crl.M.P., seeking to recall the order dated 29.10.2025. He further submits they have valid ground to raise objections in the revision in respect of the claim made by the revision petitioner.
2. Heard the learned counsel for the petitioner/respondent and the counsel for the revision petitioner.
3. Taking note of the submissions made by the learned counsel for the petitioner herein/respondent in Crl.RC., this Crl.M.P., is allowed and an opportunity is to be given to the respondent in the revision to raise his objections.
4. Accordingly, this Crl.M.P., is allowed. The order passed in Crl.R.C.No.2178 of 2025 dated 29.10.2025 is recalled.
5. Post the Crl.R.C., after restoration before the regular roster Bench on 09.06.2026. Till then the proceedings in S.T.C.No.645 of 2022 on the file of XV Small Causes Court, Chennai, is stayed.
