ORDER

This petition has been filed seeking to quash the impugned order dated 26/06/2025 in Na.Ka.No.1465 / Aa /2025 passed by the 5th respondent and direct the respondents 1 to 3 herein to dispose of the petitioner representation dated 24/07/2025 and 26/07/2025, for enquiry.

2. It is the case of the petitioner that the petitioner was joined as Guest Lecturer in the year 2017 at Thirumagal Aalai college, Kudiyatham from the year 2017 to January 2023 and he was transferred in the year 2023 to Kalaignar Karunanidhi Government Arts College, Thiruvannamalai. On 10.05.2023, practical examination was conducted for the first year students between 2 PM to 5 PM in the 5th respondent College to verify the student records and one Dr.Sudhakar was an internal examiner. The 6th respondent without staff in charge signed in the record book of the said Venkatesan. In this regard, the petitioner filed a writ petition seeking a direction against the respondents 2 to 5 for the allegation happened during University practical examinations conducted

on 10.05.2023. This Court vide its order dated 02.04.2025, disposed the writ petition with certain directions. Pursuant to the said order, the 5th respondent conducted enquiry and passed the impugned order dated 26.06.2025. Challenging the same, the present writ petition has been filed.

3. The learned counsel for the petitioner submitted that the 5th respondent has passed the impugned order without considering the actual evidence and statement which was stated by the petitioner. Hence, the petitioner made another representation on 26.07.2025 requesting to conduct a fresh enquiry by the appellate authority and therefore, this Court may set aside the impugned order and direct the respondents to consider and pass orders on the petitioner's representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader appearing for the respondents submitted that there is no objection for the respondent to consider the representation made by the petitioner.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court, without interfering with the

impugned order, directs the 3rd respondent to consider and pass orders on the petitioner's representation dated 24.07.2025 within a period of six weeks from the date of receipt of a copy of this order.
