O R D E R
The present Civil Miscellaneous Petition has been instituted seeking extension of time for three months to the petitioner to vacate the suit schedule premise.
2. This Court has already shown lenience and extended the time to vacate the premises by order dated 07.08.2025 in C.R.P.(NPD) No.3414 of 2025. Paragraph No.4 of the said order reads as under:-
4. The affidavit of undertaking filed by the petitioner is taken on record. Considering the dispute between the parties, the petitioner shall vacate the premises on or before 31.12.2025. It is made clear that if the petitioner fails to vacate the premises on or before 31.12.2025, the Execution Court shall proceed with the Execution Proceedings.
3. The petitioner has not vacated the premises and failed to comply with the said order. Now the present petition has been filed seeking extension of three months time. Since the Court has already shown leniency and fixed time limit to vacate the premises, the present Civil Miscellaneous Petition is not entertainable. 2/4
4. Therefore, the Present Civil Miscellaneous Petition stands dismissed. The decree holder is entitled to execute the decree. No costs.
