in both CRP's M/s.C. Alagu Bhavani for M/s.K.Suthan COMMON ORDER These civil revision petitions are filed seeking a direction to II Additional Family Court, Chennai to dispose of the original OP's in HMOP.Nos.3655 of 2024 and 576 of 2023 respectively.
2. HMOP.No.3655 of 2024 has been filed by the respondent against the petitioner seeking divorce on the ground of cruelty. HMOP.No.576 of 2023 has been filed by the petitioner against the respondent seeking divorce on the ground of cruelty. Both the petitions are taken up for hearing simultaneously.
3. It is seen from the e-court online status filed in the typed set of papers, the pleadings of the parties are completed and OP's are getting adjourned for enquiry from March 2025. In HMOP.No.576 of 2023, the petitioner examined herself as PW1 and the matter has been adjourned for PW1 cross from March 2025 onwards. As far as HMOP.No.3655 of 2024 is concerned, the respondent/husband failed to enter the box in spite of several directions issued by the court to file proof affidavit as early as 29.07.2025. The family court directed the respondent to file proof affidavit on the next date of hearing with condition that in case of default, the OP will be dismissed. In spite of such direction, the respondent has not filed his proof affidavit and commenced the enquiry.
4. Taking into consideration the pleadings of the parties were completed long back and OP's are adjourned for the past nine months for the purpose of enquiry, this Court is inclined to direct the family court to dispose of both the OP's as expeditiously as possible.
5. With this direction, these civil revision petitions are disposed of. No costs.
