Respondent(s) PRAYER This writ petition filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus to call for the records from the 3rd respondent pertaining to the impugned letter issued by him in Ka.No.U.Po.E/.P/Thali/V.B/Ko.Puthur/A.No.166/ 2025 dated 18.11.2025 and
quash the same and consequently direct the 3rd respondent herein to provide new service connection to the petitioner land situated in S.No. 789/2, (BSchedule) in Dhali Village, Udumalpet Taluk. For Petitioner(s):

ORDER
Challenging the impugned order directing the petitioner to obtain a No Objection Certificate from her son for providing agricultural electricity service connection to the petitioner, the present writ petition has been filed.
2. According to the petitioner, she was allotted "A" schedule property under a partition deed dated 10.12.2008. Her son was allotted "B" schedule property. For both the schedules, there exists a common pathway and other easementary rights. There is an existing Well situated in the petitioner's portion, for which she does not have an electricity service connection. On the other hand, the portion allotted to her son is having an electricity service connection to the well.
3. On 15.09.2025, the petitioner has submitted an application to the respondents seeking a new electricity service connection. However, instead of
granting service connection for the existing well, merely on the basis that the petitioner's son has raised an objection, the respondents insisted upon the petitioner obtaining a No Objection Certificate from her son.
4. The learned counsel for the petitioner would submit that the petitioner's son is inimical towards the petitioner and that insisting upon a No Objection Certificate from him, in view of the existing dispute, is wholly unjustified.
5. The learned Standing Counsel appearing for the respondents, on instructions, would submit that upon the petitioner paying the necessary charges and executing an indemnity bond, the respondents will effect service connection to the existing well.
6. In such view of the matter, let the petitioner pay necessary charges and execute an indemnity bond as required by the respondents. On such execution, the respondents shall effect electricity service connection without any further delay. Such exercise shall be completed within a period of one month from the date of receipt of a copy of this order. If any amount has already been paid by the petitioner, the same shall be refunded forthwith upon proper verification of
payment details.
